of France’s energy consumption is generated by tertiary buildings. This is one of the reasons why France has launched the Tertiary Eco-Energy scheme in 2019 through the Tertiary Decree.
What is the Tertiary Decree?
The Tertiary Decree, also known as the Tertiary Renovation Decree, is an integral part of the ELAN law (Evolution of Housing, Development and Digital). Coming into effect on October 1, 2019, it frames a number of applications with which owners and tenants of tertiary buildings must comply.
What are the objectives set by the tertiary renovation decree?
The Tertiary Decree provides for a set of measures that the actors concerned must follow. They have until 2050 to progressively achieve the reductions in energy consumption set by the decree, namely :
- 2030: 40% reduction in energy consumption.
- 2040: 50% reduction.
- 2050: 60% reduction.
Achieving these targets involves a benchmarking exercise, by selecting a baseline year between 2010 and 2019. The threshold chosen is often the year that generated the most energy consumption.
The taxpayers can also choose the “absolute” objective, by reaching a threshold of final energy consumption expressed in absolute value. The consumption threshold set by the regulation depends on the sector of activity and only concerns buildings for secondary and primary education, logistics and public service offices.
The actors concerned must make a certain number of declarations on the OPERAT platform managed by ADEME (Agence de l’Environnement et de la Maîtrise de l’Énergie) according to a precise schedule:
- 30 September 2021: compulsory declaration of tertiary buildings of more than 1,000 m2 to be filled in on the OPERAT platform.
- Between 2022 and 2050: obligation to transmit data on the energy consumption of buildings on the OPERAT platform, and this, every year.
- December 31, 2030: first control carried out to verify the achievement of the objectives set by the decree, i.e., -40% of energy consumption compared to a defined threshold.
In concrete terms, the tertiary renovation decree concerns any owner or tenant of buildings for tertiary use greater than or equal to 1,000m2, whether public or private.
This regulation concerns any surface for professional use: storage spaces, logistics sites, offices, shops, data centers, tourist accommodations, education and training facilities, health institutions, etc. Only defense and civil security buildings, places of worship and temporary constructions are not concerned.
In fact, the Tertiary Decree is the reference in terms of energy renovation. All the economic actors concerned are obliged to meet the reduction of energy consumption or face sanctions. Thus, the achievement of these objectives is at the heart of the CSR and financial services of companies.
In order to meet the obligations of the Tertiary Decree, it is essential to define a strategy and implement an action plan.
